REGULATIONS European Law

Cyprus is an official member of the European Union, since May of 2004 and joined the eurozone from January 2008. After its accession, Cyprus legislative framework has been significantly affected as local Laws and Regulations need to adhere to EU’s legislative instruments. The most prominent example is EU Directives which are legally binding but implementation is left to the discretion of Member States, giving them a limited freedom – a ‘margin of manoeuvre’ to transport it into their national Laws. Another is EU Regulations that have immediate effect (directly applicable) on Member States’ legislation.

Our firm is regularly approached by domestic and international clients regarding EU issues; whether this relates to enforcement or fights, protection of fundamental freedoms, free movement of people or goods etc. From a business perspective, whether you are already established in Europe and looking to expand, or a new investor seeking an investment conduit in Europe, we can assist you and make all the right moves to reach the most beneficial and feasible outcome for you. We offer a full range of legal advice covering all aspects of EU law.

Advising on EU law is a fast-paced-changing area of practice, so it is essential that the legal professionals who deal with such matters are fully familiar and informed with the latest legal developments. As we try to strive to be always in line with those developments, we make sure that we have the appropriate adeptness and knowledge of rulings of the Court of Justice of the European Union (CJEU), as well as domestic courts, in order to provide in-depth legal advice and guidance.

Covered areas: enforcement of rights under EU Directive 2002/58/EC, Charter of Fundamental Rights: Right to petition (Article 44), Right to good administration (Article 41), Right to an effective remedy and to a fair trial (Article 47), Presumption of innocence and right of defence (Article 48) & Scope and interpretation of rights and principles (Article 52), European Convention of Human Rights (ECHR) - Right of Fair Trial and Public Hearing (Article 6) and Preliminary Rulings on issues of interpretation or validity of EU Law.
